1. Contact

1.1 Who we are. We are SCAVO Clothing Ltd., registered in England and Wales with company number 15469394. Our registered office is at 7 Lynwood Drive, Worcester Park, KT4 7AA, England - UK.

1.3 How we may contact you. If necessary, we will contact you by telephone, email, or post using the contact details you provided when placing your order.

2. Your Order  

2.1 Order acceptance. We will accept your order when we email you to confirm it; at this point, a contract will be formed between you and us.

2.2 Order rejection. If we cannot accept your order, we will inform you and not charge you. This may happen if we have sold out, identified an error in pricing or description, or detected an attempt to use automated methods to place the order.

2.3 Order number. We will assign an order number and provide it when you accept it. Please reference this number when contacting us about your order.

3. Our Products

3.1 Availability. While we strive to ensure website functionality and product availability.

3.2 Product variations. The product images on our website are for illustrative purposes only. Actual product colours may vary slightly due to monitor calibration and operating systems.

4. Delivery

4.1 Shipping destinations. We aim to ship Worldwide

4.2 Shipping times. Estimated delivery times will be noted at checkout and when your order ships.

4.3 Delivery costs. Delivery costs will be displayed during checkout.

4.4 Missed deliveries. If no one can receive the delivery, follow the delivery provider's instructions.

4.5 Product responsibility. The product becomes your responsibility upon delivery to the provided address.

4.6 Product ownership. You own the product once we have received full payment.

4.7 Customs duties and taxes. For orders outside the UK, you are responsible for applicable customs duties, taxes, and requirements when importing products. We are not responsible for unpaid duties, taxes, or non-compliance and will not issue refunds in such cases.

4.8 Undeliverable orders. If delivery fails and you do not re-arrange delivery or collection, we may charge storage and redelivery fees. If we cannot contact you after reasonable efforts, we may terminate the contract per clause 8.2.

4.9 Delivery delays. If events beyond our control delay our supply, we will notify you and take steps to minimise the delay's impact. If a substantial delay is likely, you may end the contract and receive a refund for undelivered products.

5. Price and Payment

5.1 Payment. Prices and delivery costs (including applicable VAT or sales tax) are listed in GBP. We accept Visa, Mastercard, American Express, and PayPal.

5.2 International orders. For orders outside the UK, prices exclude import VAT, customs duties, taxes, and requirements. You are responsible for confirming and paying these charges. We will not issue refunds for unpaid duties, taxes, or non-compliance.

6. Returns Policy

6.1 Returns. If unsatisfied, you can return products for a full refund within 14 days, provided they are in perfect, original, saleable condition with all packaging and tags intact. Please return to our address: 7 Lynwood Drive, Worcester Park, KT4 7AA (UK). Refunds will be issued via the original payment method within 14 days of receiving the returned items.

6.2 Exchanges. Due to limited product availability, we cannot hold stock for exchanges. If unsatisfied, follow the returns process in 6.1. Place a new order to purchase a different item, subject to availability.

6.3 Pricing errors. If a product's price is higher than stated on the order date, we will contact you to confirm the correct price or cancel the order. If the correct price is lower, we will refund the difference.

6.4 Non-refundable items. For hygiene reasons, we cannot accept returns on underwear or swimwear unless they are faulty or misdescribed.

7. Statutory Cancellation Right You have a statutory right to cancel your order within 14 days of receiving it, separate from our returns policy.

7.1(a) How to cancel. To cancel, inform us within 14 calendar days of receiving the product by emailing scavo@scavoby.com or completing a cancellation form.

(b) Returning cancelled orders. Return the product in perfect, original, saleable condition with all packaging and tags intact within 14 calendar days of cancellation. You are responsible for return shipping costs.

(c) Refunds. We will refund the product price and outbound delivery costs using your original payment method. However, we may deduct from the refund (excluding delivery costs) if the product's value has diminished due to your handling beyond what is necessary to establish its nature, characteristics, and functioning.

(d) Refund timing. We will issue refunds within 14 days of receiving the returned product.

8. Our Rights to End the Contract

8.1 Contract termination. We may end the contract by writing to you if:(a) you fail to make a payment when due and do not pay within 14 days of our reminder, or(b) you do not, within a reasonable time, allow us to deliver the products.

8.2 Compensation. If we end the contract per 8.1, we will refund any prepaid amounts for undelivered products but may deduct reasonable compensation for costs incurred due to your breach.

10. Our Responsibility for Loss or Damage

10.1 Your legal rights. You have certain legal rights, including the right to ensure that any products ordered will be of satisfactory quality, fit for purpose, and conform to the order and description on our website. Nothing in these terms affects your legal rights.

10.2 Foreseeable loss or damage. We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious it will happen or if both parties knew it might happen when the contract was made.

10.3 Business losses. We only supply products for domestic and private use. We will not be liable for any loss of profit, business, goodwill, business interruption, or business opportunity if you use the products for commercial, business, or resale purposes.

10.4 Unlimited liability. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including your legal rights in 10.1.

 

11. Other Important Terms

11.1 Term changes. We may change these terms and conditions from time to time.

11.2 Transfer of rights and obligations. We may transfer our rights and obligations under these terms to another organisation or deal with them as appropriate.

11.3 Third-party rights. If we agree, you may only transfer your rights or obligations under these terms to another person.

11.4 Contract parties. This contract is between you and us. No other person needs to be involved in ending the contract or changing these terms.

11.5 Severability. If a court or relevant authority finds some of these terms unenforceable, the remaining ones will continue.

11.6 Delay in enforcement. If we delay enforcing this contract, we can still enforce it later. If we do not immediately require you to do something under these terms or delay taking steps against you for breaking this contract, we can take steps against you later.

11.7 Governing law. These terms are governed by English law, and you can bring legal proceedings regarding the products in the English courts.
